Virginia DOC Time Computations

I usually receive a call at least once a week asking about changes in the law regarding how the Virginia Department of Corrections (DOC) calculates time credit. Currently, all inmates serving non-mandatory time receive good credit in the amount of 4.5 days for every 30 days. Under a proposed amendment to Va. Code Section 53.1-202.3, additional credits may be earned based upon the offense, level of offense, and whether the inmate has participated in programs and followed the rules. This amendment has now been passed and the language can be found at the link below:



However, please be aware the new amendments will not go into effect until July 1, 2022.
